§ 1 Scope of Application
(1) These Terms and Conditions apply to all contracts concluded between
OPOS GmbH, Am Graben 8, 7412 Wolfau, Austria
and its customers via the online shop www.oposarms.com.
(2) Any terms and conditions of the customer deviating from or conflicting with these Terms shall not apply unless expressly agreed to in writing by OPOS GmbH.
(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
An entrepreneur is any natural or legal person or partnership acting in the exercise of their commercial or professional activity.

§ 2 Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to submit an order.
(2) By clicking the button “place order with obligation to pay”, the customer submits a binding offer to purchase the selected products.
(3) A contract is concluded only upon our order confirmation in text form (e-mail) or upon shipment of the goods.
(4) OPOS GmbH reserves the right to reject orders without stating reasons, in particular for legal, regulatory or firearms-related concerns.

§ 3 Prices and Payment
(1) All prices are stated in euros and include statutory VAT unless expressly stated otherwise.
(2) Shipping costs are shown separately during the ordering process.
(3) Payment is due immediately upon conclusion of the contract.

§ 4 Delivery and Transfer of Risk
(1) Deliveries are made exclusively to legally authorized persons and only after successful age and identity verification.
(2) For consumers, the risk of accidental loss or deterioration passes to the customer upon delivery.
For entrepreneurs, the risk passes upon handover to the carrier.
(3) Delivery times are non-binding unless expressly agreed in writing.

§ 5 Sale of Firearms and Firearms-Related Products
(1) Sales are made exclusively to persons of legal age (18+).
(2) For firearms or essential firearm components subject to authorization, a valid firearms permit under Austrian law (WaffG) must be provided prior to delivery.
(3) OPOS GmbH reserves the right to refuse delivery if legal, regulatory or security concerns exist.
(4) The customer confirms that:

all information provided is accurate and complete;

they are legally entitled to acquire the goods;

the goods will not be transferred to unauthorized third parties.

§ 6 Retention of Title
Goods remain the property of OPOS GmbH until full payment has been received.

§ 7 Warranty
(1) Statutory warranty rights under Austrian law apply.
(2) For entrepreneurs, the warranty period is 12 months from delivery.
(3) No warranty is provided for:

normal wear and tear;
-
improper use or handling;
-
unauthorized modifications;
-
use of non-approved or improper ammunition.

§ 8 Liability
(1) OPOS GmbH is liable only for intent and gross negligence, insofar as legally permissible.
(2) Liability for indirect damages, consequential damages, loss of profit or financial losses is excluded to the extent permitted by law.

§ 9 Right of Withdrawal (Consumers)
Consumers have a statutory right of withdrawal pursuant to the Austrian Distance and Off-Premises Contracts Act (FAGG), unless a legal exception applies (e.g. customized or personalized goods).

§ 10 Governing Law and Jurisdiction
(1) These Terms are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) The place of jurisdiction for disputes with entrepreneurs is Graz, Austria.

§ 11 Severability Clause
Should any provision of these Terms be invalid or unenforceable, the remaining provisions shall remain unaffected.
